In Utah on November 27. 2018 Alan D. Covington walks inside a tire store. In the store shopping, are the two Latinos Jose Lopez and his son Luis.
After shouting that he wanted to “kill Mexicans”, Covington proceeds to attack both men with a 3-foot-long metal pole, leaving them both injured.
A hate crime is essentially when a crime is committed with at bias. That bias can be many things but by federal law, hate crimes stem in race, sexuality, gender, gender identification, religion or disability.

Under the First Amendment of the U.S. Constitution, people cannot be killed for their beliefs. It is not a crime to express offensive beliefs, or to join with others who share such views.
However, the First Amendment does not protect against committing a crime, just because the action is against personal beliefs.
The legislation on hate crimes varies across the country. According to the Justice Department in the US, bias motivations and penalty enhancements can vary widely.
Some jurisdictions define what a hate crime consists of differently than what federal law states, therefor they can include or exclude some of the different bias motivations.
